Meeting Minutes
January 21, 2009

Present were Chairman, Frank Lynch and members Russell Clark and Michael Vazza, Director Jennifer Sullivan and Secretary Pam Mullin. Selectman Shawn Harris was also present.

Motion by Russell Clark to approve Agenda and Meeting Minutes of December 15, 2008 and January 5, 2009, seconded and approved unanimously.

7:15 p.m. 135 River Street/Public Hearing/EET/Raftery

Bob Crawford presented for the homeowner. There were no abutters present.

Variances/upgrades requested:

Leaching to property line 6’ vs. 10’
Leaching to crawl space 12’ vs. 20’
Septic tank to crawl space 5’ vs. 10’

Motion by Russell Clark to approve, seconded and approved unanimously

7:30 p.m. 19 Wood Island Road/Public Hearing/P. Benkart
Metsisto

Variances/upgrades requested:

Setback – SAS to wetlands 27’ vs. 50’
Sieve analysis in lieu of perc test
Reduction in amount of naturally occurring pervious material 3’ vs. 4’
Using Jet system and pressure dosing
Requires DEP approval, deed restriction and inspection, testing and maintenance contract
Green cards received

Director Sullivan presented for the engineer. There were no abutters present.

Wetlands and ledge predominant on this property. The design also indicates the need to relocate the existing water line

Motion by Russell Clark to approve, seconded and approved unanimously.

7:35 p.m. 96 & 100 Glades Road/Public Hearing/Murphy/Canale

96 Glades Road – Variances and upgrades requested:

SAS to cellar wall 16’ vs. 20’
SAS to property line 5’ vs. 10’
Septic tank not elevated in velocity zone because the house isn’t

100 Glades Road – Variances and upgrades requested:

Septic not elevated in velocity zone because house isn’t

NOTE: #96 needs easement and #100 for water line

Scott Arnold of Murphy Associates presented for the homeowners. Mr. & Mrs. Canale were also present. There were no abutters,

Motion by Russell Clark to approve #96 subject to easement, seconded and approved unanimously.

Motion by Russell Clark to approve #100 subject to water line placement, seconded and approved unanimously.

7:45 p.m. #25, #29 and #35 Bayberry Road/Public Hearing/EET/McKenzie

Shared system. Board must approve contingent on satisfactory legal documents and easements (not available yet due to expense if plan is not approved). All sized at 4 bedrooms.

#25 Bayberry Road

Variances and upgrades requested:

Sieve analysis in lieu of perc test
SAS to property line 5.5’ vs. 10’
SAS to wetlands 9.2’ vs. 50’
SAS to max groundwater 3’ vs. 5’ with perc <2 mpi
Invert elevation of septic tank and pump chamber not 12” above ESHGW

#35 Bayberry Road

SAS and force main located in easement
SAS to wetland 9.2’ vs. 50’

Invert elevation of septic tank and pump chamber not 12” from ESHGW

NOTE: 29 Bayberry Road – knockdown and build new house previously approved for 5 bedroom tight tank. Under this design it can only have 4 bedrooms.

Bob Crawford presented for the homeowner. John Snow owner of #35 Bayberry Road and Thomas Goodrich of 25 Bayberry Road were also present. Attorney Rod Scanlon was also present.

Attorney is to present required legal paperwork to Director prior to being forwarded to DEP for approval.

There were no abutters.

Motion by Russell Clark to approve #25, #29 and #35 Bayberry Road subject to satisfactory legal documents, seconded and approved unanimously.

7:55 p.m. Gannett Grille/Jamies Pub/Public Hearing/Constantine

This system must also be approved by DEP. It will be subject to a deed restriction and inspection, maintenance and testing contract. I would recommend an annual inspection report to the Board of Health and that the quarterly inspections include the grease trap. Once the system is constructed and approved, I think the owner should pay for cleaning the storm drain.

Septic tank to property line 3’ vs. 10’
Pump chamber to property line 1.1’ vs. 10’
Jet system tank to property line 0.3’ vs. 10’

50% reduction in SAS from 14,000 sq. ft. to 7,000 sq. ft.
Reduction in groundwater 4’ to 2’

NOTE: Property lines must be surveyed due to very small setbacks required by variances. Retain present grease trap.

Rick Grady of Grady Consulting presented for the property owner. Attorney Ben Albanese was also present. Abutter Mr. & Mrs. Philip Flaherty of 15 Mordecai Lincoln Road were also present.

When DEP approves this plan (normally takes between 60 and 90 days to approve) Director will notify board members. Must impose a deadline for completion. Check previous meeting minutes for completion timetable.

Motion by Russell Clark to adjourn meeting at 8:30 p.m., seconded and approved unanimously.
