Meeting Minutes
August 17, 2009

Present were Chairman, Frank Lynch and member Michael Vazza, Director Jennifer L. Sullivan and Secretary Pam Mullin.

Motion by Michael Vazza to accept Agenda and Meeting Minutes of July 6, 2009, seconded and approved unanimously.

7:10 p.m. 248-250 Gannett Road/Public Hearing/Ross Engineering/Wilder

Paul Mirabito presented for the homeowner. There were no abutters present.

Variances requested:

Setback to coastal bank from SAS - 25’ vs. 50’
Setback to subsurface drains from tanks – 0’ vs. 25’
Setback to subsurface drains to SAS – 14’ vs. 50’
System in easement adjacent property – DEP approval required
Deed restriction and contract for inspection, maintenance and testing

Motion by Michael Vazza to approve, seconded and approved unanimously.

7:20 p.m. 46 Fay Road/Public Hearing/Williams/Continued

At the request of the Board of Health Mr. Williams has been ordered to obtain an exterminators opinion to determine if there is vermin present on his property. Once this information is obtained, Mr. Williams is to present the Board with a copy of their findings by August 10, 2009. There was no response from Mr. Williams. Williams claims there is no vermin on his property and considers this request unnecessary and harassing.

Chairman Lynch acknowledged the clean up has taken place, but to satisfy his neighbors and the Board, again request Mr. Williams to hire an exterminator and appear before the Board of Health at their next scheduled meeting.

Motion by Michael Vazza to approve this request, seconded and approved unanimously.

Motion by Michael Vazza to adjourn meeting at 8:00 p.m. seconded and approved unanimously.
