Board of Health, January 11, 2010 TOWN OF SCITUATE MASSACHUSETTS Board of Health
Motion by Russell Clark to approve Agenda with deletion of including discussions regarding the budget and fees, seconded and approved unanimously. 7:10 p.m. 7 Drew Place/Reynolds/Housing Violations As you can read from the inspection report and violation notice there is a list of violations. The tenant is a tenant at will and there was an eviction hearing on January 6, 2010 in housing court. I spoke with Attorney Najarian (Reynolds attorney) and according to him, the court gave the tenant 60 days to vacate. He said Charlie fixed the toilet. There are security issues with the back door (kitchen to porch) that also should be addressed now. In spite of all the problems, the place is not condemnable yet. If the tenant is going to vacate, I would suggest the Board order no further occupancy until the violations are corrected and approved by this department. Charlie Reynolds was present, the tenant was not. There were no abutters present. Motion by Russell Clark to approve subject to the premises passing reinspection by the Health Director before another tenant occupies, seconded and approved unanimously. 7:20 p.m. 43 Surfside Road/White/Housing Variances All corrections have been made and the Building Commissioner has approved a second exit. The only outstanding item is the existing ceiling is 2” less than required, as the health code does not provide for any “grand fathering” as the building code does. The Director is in favor of granting this variance. Mrs. White was present for the meeting. There were no abutters present. All violations have been corrected. The exception is the ceiling height. Motion by Russell Clark to approve variance allowing 2” shortage of ceiling height, seconded and approved unanimously. As a follow-up to a telephone message given to Michael Vazza, he returned a call from Marybeth Klein a resident at 9 Pondview Avenue. She called complaining about the premises at 12 Pondview Avenue. Alleges broken windows and doors, trash everywhere and a general eyesore to the neighborhood. Michael returned the call and will follow-up with the Director.
