Board of Health, January 24, 2011 TOWN OF SCITUATE MASSACHUSETTS Scituate Board of Health
The Scituate Board of Health held a public hearing on January 24, 2011 at the Scituate Town Hall located at 600 Chief Justice Cushing Highway. The meeting was called to order at 7:00 p.m. Motion by Michael Vazza to accept Agenda, seconded, all in favor, unanimous. The first application was read into record: A request for a variance for the property located at 136 Indian Trail: Reduction in retaining wall location setback to the property line from the local requirement of 10’ to 3.5’ Kevin Grady presented for the homeowner. There were no abutters present. This is a new lot with copius amounts of ledge consuming most of the property except as indicated by engineer’s plans the location of tank and leaching field. Proposed septic system will be elevated with a concrete retaining wall 3-1/2 feet from the property line and 4-1/2’ high. There was no objection to this plan when before the interim Conservation Agent, Paul Shea regarding the stormwater by-law. Motion by Michael Vazza to approve local variance, seconded by Lynch, unanimous. The second agenda item was read into record: Cavanaugh Road local variance for request in reduction in retaining wall location setback to the property line from the local requirement of 10’ to 2’. Needs stormwater by-law review by Conservation Commission before proceeding. The distance from the tank and leaching field to the street necessitates a stone wall with poly barrier and not a concrete wall. Kevin Grady presented for the homeowner. There were no abutters present. Motion by Michael Vazza to approve local variance using only stone wall construction, seconded, all in favor, unanimous. The third agenda item was read into record: 144 Vernon Road local variance requested depth to groundwater. Reduce the required vertical separation to groundwater from 4’ to 2’. Also requested is to allow the reduction of the SAS from 100% to 50%. Greg Morse presented for Engineer Phil Spath. Abutter Rawsin Lawrance of 147 Vernon Road was also present. Mr. Lawrance has no objection to this new septic system design. Motion by Michael Vazza to approve local variance and allow reduction in SAS from 100% to 50%, seconded, all in favor, unanimous. Motion by Michael Vazza to adjourn meeting at 8:00 p.m., seconded, all in favor, unanimous. Respectfully submitted,
