Board of Selectmen, November 13, 2006 MINUTES OF MEETING BOARD OF SELECTMEN NOVEMBER 13, 2006
Richard H. Agnew, Town Administrator 1. The meeting was called to order at 6:30 PM. 2. ACCEPTANCE OF AGENDA Mr. Harris made a MOTION that the Board of Selectmen VOTE to ACCEPT the Agenda for November 13, 2006. 3. DISCUSSION/ VOTE/ SPECIAL TOWN MEETING ARTICLES Article 6 - The Planning Board has recommended a word change (“shall”) within the text of Article 6 – ZBL – Review of ZBA Applications by Design Review Committee. Mr. Harris made a MOTION that the Board of Selectmen VOTE to SUPPORT Article 6 – ZBL – Review of ZBA Applications by Design Review Committee as AMENDED by the Planning Board. SECONDED by Mr. Murray. No discussion. Unanimous vote. (5-0) Article 8 – The Planning Board recommends amending this Article to include the Map and Lot numbers for this property. Mr. Murray made a MOTION that the Board of Selectmen VOTE to SUPPORT Article 8 – ZBL – Zoning Map Change as AMENDED by the Planning Board. SECONDED by Mr. Norton. No discussion. Unanimous vote. (5-0) Article 5 – South Shore Habitat for Humanity – Mr. Agnew assured the Board that the $50,000 would not be transferred from Community Preservation Act funds until the deed on the property has been transferred to Habitat for Humanity. Article 11 – The petitioner, Ms. Doreen Close, changed the wording on this petition at the November 7, 2006 Selectmen’s meeting as follows: (1) instead of “design found in historic buildings of these areas” – it will now read “design found in historic buildings of the Business District” and (2) add “the appearance of authentic wood clapboards or shingles shall be maintained”. The Selectmen voted these changes on November 7, 2006. No further changes to this Article were voted this evening. Article 13 - ZBL – Off Street Parking – It was the Board’s understanding that the Town Moderator, Mr. Richard Bowen, was going to rule this Article “out of order” because its present language was substantially different from what was advertised at the Planning Board’s public hearing. Ms. Close asked that Mr. Bowen speak to the Board about this Article. Mr. Bowen stated that he had decided to let the Article go forward as written. The Selectmen allowed it to be placed in the warrant for this Meeting and it has been published. He will let the residents vote on it and ultimately the State Attorney General’s office will make a determination. Mr. Harris made a MOTION that the Board of Selectmen VOTE to RECONSIDER Article 13. There was no Second to the Motion. 4. DISCUSSION/ VOTE/ Memorandum of Understanding/ Historical Society Mr. Murray stated that the Memorandum of Understanding (MOU) between the Scituate Historical Society and the Town of Scituate, that he distributed this evening, is the final version. The words in Item 7 “it is agreed that every effort will be made by the Board of Selectmen to appoint ….” were recently inserted and agreed to by all parties. He further noted that if Article 15 – Historic Commission – fails this evening, then Item 7 would not apply. It was noted that the MOU should have been “in place” prior to any discussions on a Historic Commission. Mr. Murray made a MOTION that the Board of Selectmen VOTE to ACCEPT the Memorandum of Understanding between the Scituate Historical Society and the Town of Scituate. Item 7 will be included in the Memorandum of Understanding pending the successful passage of Article 15 – Historic Commission. SECONDED by Mr. Pollard. No discussion. Unanimous vote. (5-0) 5. OTHER BUSINESS Mr. Norton recently received information on MBTA “practice runs” for the Greenbush rail. He asked if the train education program, taking place in the Scituate Schools, has been completed yet? It was thought that the program was still taking place. The Board agreed that a letter should be sent to the MBTA as soon as possible questioning the “practice runs”. 6. ADJOURNMENT Mr. Pollard made a MOTION that the Board of Selectmen VOTE to ADJOURN tonight’s meeting at the close of the Special Town Meeting (approximately 10:15 PM). SECONDED by Mr. Norton. No discussion. Unanimous vote.
