Mrs. Chisholm called the meeting to order at 7:32 p.m.

ACCEPTANCE OF AGENDA: Mr. Vogel moved to accept the agenda as written. Dr. Afanasenko seconded the Motion and the vote was unanimous.

Common Driveway Special Permit – Applicant Requests Change to Condition 4
Between 87 & 103 Tilden Rd. Assessor’s Map # 45-1-3-A
Applicant: Paul Mirabito, Trustee Owner: Paul Mirabito

Mr. Mirabito addressed the Board. He read aloud the proposed condition #4 on the decision for his Common Driveway located at 87 & 103 Tilden Road. He explained he had two issues with this condition. First, this type of condition has never been used on a Common Driveway before. Second, a condition of this type would make securing a loan on the property difficult for potential buyers. Mr. Mirabito asked the Board to reword the condition to state the following:

4. The common driveway and its entire drainage system shall be owned by the homeowners and shall not be maintained by the town. A maintenance agreement shall specify that the maintenance and repair of the common driveway and drainage system are the responsibility of the owners of Lots 1, 2 and 3.

Mrs. Chisholm asked Ms. Harbottle for comment on the request. Ms. Harbottle stated that Mr. Limbacher had requested the original language be there and it’s not a bad idea but Mr. Mirabito has a point and we should think about how to better craft the wording for the future.

MOTION: Dr. Afanasenko moved to accept the new language for condition #4 on the Common Driveway decision for 87 & 103 Tilden Road. Mr. Limbacher seconded the motion and the vote was unanimous.

ACCOUNTING:
MOTION: Dr. Afanasenko moved to approve the following purchase orders. Mr. Limbacher seconded the motion and the vote was unanimous.

1. MAPD - $75.00
2. Aspen Publishing - $137.59

Old Business, New Business, Correspondence, Administrative Items, Updates

Mr. Limbacher informed the Board that the first meeting of the Zoning Bylaw review Committee had taken place on 9/9/09. He stated the meeting went well and was very productive. Barbara St. Andre will work on the items discussed and the committee will meet again on 9/30/09.

Ms. Harbottle told the Board that Neil Duggan had an issue with the approved Stormwater Regulations. She said he feels rather than having Planning handle some applications, Conservation should handle them all. Ms. Harbottle recommended that the Board change some of the language to spell out what Conservation handles anyway and what Planning would handle. Mrs. Chisholm asked if it would require the Board to re-open the Public Hearing. Mr. Limbacher suggested that they wait until a decision is made on what should be changed.

Site Plan Waiver for construction of Ticket Booth and
Covered Picnic Area at SHS Football Field
Applicant: Dave Lawrence for Mahoney Family

Mr. Dave Lawrence and Mr. Bruce Wait addressed the Board representing the Mahoney Family. They presented to the Board a plan showing where the new structures will be in relation to the existing structures on the property. Mr. Vogel asked if the ticket booth would be the same width as the existing asphalt. Mr. Lawrence responded yes. Mr. Vogel asked if the back wall of the picnic area has to be solid to the street. Mr. Lawrence replied that the wall is solid for support but he could check with the engineer. Mr. Lawrence stated that they will paint the concession stand at the same time so all three structures will match.

MOTION: Mr. Limbacher moved to approve the Site Plan Waiver for construction of a ticket booth and covered picnic area at the SHS football field. Mr. Vogel seconded the motion and the vote was unanimous.

Ms. Harbottle informed the applicant that he should inquire with DPW as to whether he needs a trench permit from the State.

Motion to Adjourn: Motion duly Moved by Mr. Limbacher. Seconded by Mr. Vogel and voted unanimously to adjourn at 8:01 P.M.
