Mr. Limbacher called the meeting to order at 7:30PM. He announced the meeting was being audio recorded and asked if there were any other recordings being taken. There were none.

ACCEPTANCE OF AGENDA: Dr. Afanasenko moved to accept the agenda. Mr. Monger seconded the motion and the vote was unanimous in favor.

Discussion: Safety and access improvements, exit from parking lot between 146 and 164 Front St.

Mr. Jonathan Kuhn, Hamilton Group, addressed the Board. He handed out a plan and pictures of the proposed work to make the exit at the Welch building safer. He said they have already installed a speed bump. It will be painted white. They have ordered two pedestrian crossing signs, which they will mount on the existing stop sign and the other on the side of the building. They have also put up a one-way do not enter sign at the exit and two at the entrance.

The Board felt these measures were a big improvement and thanked Mr. Kuhn for addressing this issue.

Ms. Harbottle said a date has not yet been set for Special Town Meeting. We have two items that will need to go on for the Green Communities program which are the Solar Photovoltaic installation zoning and the Stretch Code. We have a workshop on Stretch Code scheduled for 9/14/10.

Ms. Harbottle said the economic target area previously discussed for the wind turbine is not going to move ahead but the Economic Development Committee when created may want to move forward on that. There is an alternative which is similar that would designate Scituate a recovery zone. It would allow anyone doing business within the zone to access stimulus money.

Mr. Limbacher updated the Board on the proposal for the FloDesign wind turbine. He said there was an onsite meeting and there has been a fair amount of interest in the RFP.

MOTION: Mr. Monger moved to approve the following purchase order. Mr. Limbacher seconded the motion and the vote was unanimous in favor.

Attorney Michael Hayes addressed the Board representing the applicant. He said the applicant was misnamed on the agenda. The applicant is now Tilden Woods, LLC rather than Diamond Development Realty Trust. On 7/24/08 the Planning Board approved a Preliminary Plan for this property. The approved plan is almost identical to the most recently submitted plan. Some of the changes had to do with the new zoning bylaws as well as the name to reflect Tilden Woods LLC and some title references. The Definitive Plan was not brought forward at that time due to the economy. In the interim on 8/5/10, Governor Patrick signed into law Chapter 240 of the Acts of 2010 extending permits in existence between 8/15/08 and 8/15/10. Attorney Hayes believes this application applies to this law and should be extended two years making the time to file the Definitive Plan by January 2011.

Mr. Limbacher asked Ms. Harbottle and the Board for comments on how the law applies to this application. Ms. Harbottle said that she agrees the law applies to this application. Mr. Monger said he also believes the law applies to this application; however, it does not require any action by the Planning Board further than an acknowledgement. Mr. Limbacher asked Ms. Harbottle when the decision was filed. Ms. Harbottle responded it was filed on 7/31/08. The Board agreed that the original application was in existence and should be extended as requested.

Attorney Hayes gave an overview of the plan to the Board. The purpose of the Preliminary Plan is for density. The plan they will file with be a Flexible Open Space Development. Mr. Monger asked what there timing was on the Definitive Plan. Attorney Hayes responded as soon as possible.

Mr. Vogel asked if there are any issues. Mr. Limbacher responded granite curbing, iron ductile pipe and looping of the water. Attorney Hayes said that they are speaking with some of the abutters to acquire an easement for the water loop. He said his client would prefer to only use granite curbing around the entrance and detention basins. He said they would rather use cape cod berms where possible. Mr. Limbacher said he would like to see a smaller detention basin, a change to the size of the roadway and water loop.

Ms. Harbottle said she agrees with the water looping and added that it would benefit Pennfield Rd. She stated that the Board does not have to waive granite curbing but, if the Board chooses to, the public should benefit in some way because the cost to the developer would be lower. She would like to encourage use of LID approach to reduce Stormwater issues.

Mr. Limbacher asked the public for comments. Mr. Clem Tennaro, 34 Pennfield Rd. asked for an explanation on the process for looping the water. Mr. Limbacher gave an explanation. Mr. Peter Paliulis, 10 Pennfield Rd., asked if all 20 acres were being used for the 15 lots and did they perc. Attorney Hayes responded they had 15 successful percs. Mr. Limbacher added that recent changes to the Flexible Open Space bylaw would require they set aside 30% for open space. Mr. Paliulis asked if that was wetlands or upland. Mr. Limbacher responded it could be a combination. Mr. Paliulis asked if the river that runs between his house and his neighbor’s is shown on the plan. Mr. Limbacher said it would be on the definitive plan. Ms. Mary Clark, 61 Hughey Road, asked how close the detention basin is to the existing houses. Attorney Hayes explained that the final design and location of the basin is yet to be determined. Mr. Joe Durkin, 24 Pennfield Road asked about the grading due to the high ground water table. Mr. Limbacher responded that is why the applicants will file a Flexible Open Space plan so they can cluster homes together and minimize fill.

Mr. Limbacher explained that this is just a preliminary plan and most issues will be dealt with when the definitive plan is filed. Mr. Chris Patten, 57 Elm St., asked when the definitive plan would be filed. Attorney Hayes replied they expect to file within the next 2-3 months. Mr. Limbacher asked if the applicants plan to meet with the neighbors before they file the definitive plan. Attorney Hayes responded yes.

MOTION: Motion to adjourn duly moved by Mr. Vogel seconded by Dr. Afanasenko and voted unanimously to adjourn at 8:52 p.m.
