Agenda: Motion to amend the agenda to include an Executive Session for litigation purposes Mr. Urbanski. Second Mr. Bjorklund. Motion passed by unanimous vote.

Agent’s Report: Timpany, 538 Hatherly Road: Plans seem adequate, but may recommend including a fence and sign stating wetland area.
Plan for Dias, thinks sufficient file NOI for the project, which will include mitigation, notify abutters and have public hearing.

Correspondence: Sitec report 1 Heritage Trail: essentially growing back, talking about establishing buffer zone, granite bound situation, also putting a restriction in the buffer zone. See if the vegetation is satisfactory. Pictures make it look good. No punitive thing for violating the wetlands Act. Perhaps discuss at next meeting.
Massey, 134 Humarock issues crossing property. Requests a temporary chain link fence until final orders are in place. No problem.

Enforcement Order: 29, 31 & 33 Surfside Road
Atty. Adam Brodsky was present representing the O’Briens, 29 Surfside; Joanne Correale, Tr., & the Mitchells, Tr, 31, and the Donovans, 33. Stan Humphries and Carlos Pena hired. Solutions: 1) Cut rebar off existing slab, back fill with material on site, and file a Notice of Intent. Compact it down, make sure as tight as took out. Existing rip-rap in front; obvious the seawall is the resolution. Built up rip-rap. 2) backfill and never see them again. Need something that would be recorded on the title. Backfill as soon as possible. No doubt that this shouldn’t have gone forward. Assure the Commission that they will file. Intention is to keep the concrete. Requested 60 or 90 days to file a NOI. Stabilize; then come back. Emergency Certification is not filed on the deed. Mechanism where they are enticed to come back and file. Record the Emergency Certification at the Registry. From a structural standpoint, cut rebar at level of concrete; 1-1/2’ of concrete. Motion to issue an Emergency Certification Mr. Bjorklund. Second Mr. Snow. Motion passed by unanimous vote.

Request for Determination: Seidel, 75 Collier Road (deck)
Mr. Stewart announced he lives at 28 Collier Rd. Paul Mirabito was present at the hearing. Proposing to do minor work on the marsh side; bump out at rear portion of house. First floor level, bay window, supplement with another deck 7’ or 8’ out. Existing brick walkway and patio will remain. Installing 4 or 5 sonotubes in an area already disturbed. North River Commission approved. All hand dug. Motion for a negative 2 determination - “The work described in the Request is within an area subject to protection under the Act, but will not remove, fill, dredge, or alter that area. Therefore, said work does not require the filing of a Notice of Intent.” Mr. Urbanski. Second Mr. Snow. Motion passed by unanimous vote.

Request for Determination: Graham, Lot 61A Cross Street (grading related to new dwelling)
David Frenette, Frenette & Dukess, and Jennifer Turcotte were present at the hearing. Grading within buffer. Suggestion was made to grade slightly into the buffer to remove the wall. Had the wetland line approved 3 years ago; confirmed line in back. A revised plan should be submitted to show the removal of the versa-lock wall, revised grading and haybale line. Motion for a negative 3 determination - “The work described in the Request is within the Buffer Zone, as defined in the regulations, but will not alter an Area subject to protection under the Act. Therefore, said work does not require the filing of a Notice of Intent, subject to the following conditions (if any).” Submit a revised plan showing removal of wall, sediment control and revised grading into the buffer Mr. Bjorklund. Second Mr. Urbanski. Motion passed by unanimous vote.

Request for Determination: Acosta, Tr./Squeek Realty Tr., So. River (maintain bottom anchored moorings for floats & racks)
Gene Gimont t was present at the hearing. This filing is part of applicant’s Waterways and Army Corps filing. Process requires either an RDA or NOI filed; 10A filing with Scituate Harbormaster. There have been 26 bottom anchored moorings for 30 - 40 years. Jurisdictional area, no work proposed. There are issues with abutters and others that want to put floats in there. Would have to come back if work was proposed. Don Hourihan: been there over 50 years. Mr. Bjorklund: to say that the floats have been there for years is a misstatement. Basically all new piers; wooden structures have been changed, decreased in some areas, and increased in others. When look at elevations, boats will sit on the bottom at negative tides. Boats have not bottomed out there. January will file a 10A license with the Harbormaster. Motion for a negative 2 determination - “The work described in the Request is within an area subject to protection under the Act, but will not remove, fill, dredge, or alter that area. Therefore, said work does not require the filing of a Notice of Intent.” Mr. Greenbaum. Second Mr. Snow. Motion passed by unanimous vote.

Request for Determination: Christie-Carme, 15 Town Way Extension (new home on existing wood piles)
Lois Christie-Carme and John Anthony, builder, were present at the hearing. Rebuild burned out home on existing pilings. One broken brace needs repairing. They have an elevation of 17’6” and base flood elevation is 18’. Requirement is 1’ above base flood elevation. Typically if more than 50% have to meet all new requirements. Could marry something to the existing pilings to bring up. Before fire, met all heights. Ralph Cole indicated it was minimally below because the maps were changed. Makes it 1-1/2’ below. Better to get the extra 1-1/2’; better for insurance purposes. Should be able to raise it enough. Materials will be brought in on a daily basis. Submit revised plan showing the top of the piles at 19’. Motion for a negative 3 determination - “The work described in the Request is within the Buffer Zone, as defined in the regulations, but will not alter an Area subject to protection under the Act. Therefore, said work does not require the filing of a Notice of Intent, subject to the following conditions (if any).” A revised plan shall be submitted for approval by the Commission showing the top of the piles at 19’ and stamped by a structural engineer Mr. Snow. Second Mr. Urbanski. Motion passed by unanimous vote.

Request for Determination: Murley, 142 Oceanside Drive (addition)
Kevin Plourde was present at the hearing. 5’x14’ addition for kitchen renovation on street side of dwelling. No machines; will hand dig. Would allow a small machine. Work proposed in courtyard area. Not sure if touching the set of concrete stairs. Says existing concrete steps to be removed and 4’ fencing to be removed, gate and planting bed. When talked to homeowner none of this was going to happen. Cut back stairs only if necessary. Motion for a negative 3 determination - “The work described in the Request is within the Buffer Zone, as defined in the regulations, but will not alter an Area subject to protection under the Act. Therefore, said work does not require the filing of a Notice of Intent, subject to the following conditions (if any).” The concrete stairs will be cut back only if necessary. Mr. Snow. Second Mr. Greenbaum. Motion passed by unanimous vote.

Request for Determination: Satuit Boat Club, 66 Jericho Road (replace deteriorating piles)
Bill Evans, on behalf of Satuit Boat Club, was present at the hearing. Letter from Harbormaster Mark Patterson that piles needed replacing. Pull old and put in new. Motion for a negative 2 determination - “The work described in the Request is within an area subject to protection under the Act, but will not remove, fill, dredge, or alter that area. Therefore, said work does not require the filing of a Notice of Intent.” Mr. Urbanski. Second Mr. Snow. Motion passed by unanimous vote.

Request for Determination: Town of Scituate/Recreation Dept., Hatherly School, Ann Vinal Road (create gravel parking)
Bruce Wait, Wait Land Use Consultants, was present at the hearing. Present as Recreation Commissioner. New field built for soccer and lacrosse. Requesting to put parking on either side of driveway. Shaded area on plan shows parking. About 54 spaces. 10’x20’. Proposed to be hard packed gravel surface. Cut back the hill and put fill at one end. 2 existing catch basins, intent to keep water going to them as now. Wetland is across the street, delineated when field was built. 50’ buffer along edge of parking area. Working with Jim Montanari from DPW; will work with the contractor. Catch basins empty into a manhole, connected and piped all the way down Ann Vinal Road, does not go into the wetland. No curbs. Will comply with Scott Roberts’ request to leave 10’ - 15’ buffer zone between parking and his property. Motion for a negative 3 determination - “The work described in the Request is within the Buffer Zone, as defined in the regulations, but will not alter an Area subject to protection under the Act. Therefore, said work does not require the filing of a Notice of Intent, subject to the following conditions (if any).” Haybales shall be placed along the road to hold any sediments. A row of trees or rocks shall be placed along the front to keep vehicles from entering. Mr. Snow. Second Mr. Urbanski. Motion passed by unanimous vote.

Wetlands Hearing: Bjorklund, 530 Chief Justice Cushing Hwy. (12 lot subdivision) (cont.)
Steve Bjorklund recused himself. Applicant requested a continuance to January 7, 2008. Motion to continue to January 7, 2008 at 6:35 p.m. Mr. Urbanski. Second Mr. Greenbaum. Motion passed by unanimous vote.

No Board of Health approval. Motion to continue to January 7, 2008 at 6:30 p.m. Mr. Urbanski. Second Mr. Snow. Motion passed by unanimous vote.

Wetlands Hearing: Meisterman, 769 Country Way (septic) (cont.)
Has Board of Health approval. Motion to close the hearing Mr. Bjorklund. Second Mr. Urbanski. Motion passed by unanimous vote.

Enforcement Order: Horton, 8 Buttonwood Lane (cont.)
Buttonwood Lane and Bailey’s Causeway – wetland 1’ off property line. Wetland being destroyed. Spoke to Attorney Mayo. Explained what we were requiring. Continue to next meeting.

Wetlands Hearing: Woolf, 25 Julian Street (septic) (cont.)
No Board of Health approval; went to DEP; thought agreed how to handle it. Should have special condition if house should be rebuilt. Motion to continue to January 7, 2008 at 7:00 p.m. Mr. Urbanski. Second Mr. Greenbaum. Motion passed by unanimous vote.


Wetlands Hearing: Casey, 27 Surfside Road (addition) (cont.)
David Ray and Mr. Casey were present at the hearing. Mr. Bjorklund and Mr. Kalishes met concerning different performance standards: make piers deeper, or continuous foundation deeper. Prepared to make it 5’ below finished grade – bottom of strip footing. Site slopes slightly; continuous level. Can amend drawings. Submit 2 copies of revised plans. Motion to close the hearing Mr. Urbanski. Second Mr. Bjorklund. Motion passed by unanimous vote.

Wetlands Hearing: Gowdy, Hatherly & Tilden Roads (250 units) (cont.)
Matt Lundsted, Paul Marchionda, Phil Henry, and Matt Lundsted, from CEI for Commission were present at the hearing. Gone through many hours of review. Initial filing last summer. Site walk, couple of workshop sessions. Initially many comments. At this point addressed all comments from CEI. Matt Lundsted - overview of changes: all stormwater concerns were handled; asked for additional test pits at stormwater locations, received soil types, stained elevations, were able to establish recharge more consistently; wetland component at the bottom. Agreed upon plantings. Commission discussed: Removal of concrete roadway when project mostly done. Area will be mostly grassed, houses and roadway, (impervious surfaces), understand stormwater management, but will any compensation be made for all the lawns being watered all summer long? No calculations done. Designed site to have no adverse impact toward Hatherly Road. LSP on site monitoring demolition of existing buildings. Convinced all the changes have been made to the plans. Neighbors largest concern is to make sure control situation of any contamination on site. Linda Ferguson, abutter: pleased came tonight, seems to be the first time the Board is doing their job and Poulty is cooperating. Hope they will use air quality monitors. Appreciate the work that has been done. Motion to close the hearing Mr. Bjorklund. Second Mr. Urbanski. Motion passed by unanimous vote. Commission asked the applicant’s representative to waive the 21 days regarding issuance of the Order of Conditions, since the Commission is not meeting until January.

Wetlands Hearing: Solimando, 8 Dartmouth Street (replace docks/20 slips/boardwalk) (cont.)
Mr. Solimando has not been heard from since his surgery. Carlos Pena did initial review of plans. Some items that need addressing before it goes any further. Planning at issue. Don Hourhihan: not at Waterways either. Motion to continue to January 7, 2008 at 7:05 p.m. Mr. Urbanski. Second Mr. Bjorklund. Motion passed by unanimous vote.

Wetlands Hearing: Schanze, 6 Oceanside Drive (elevate & new deck) (cont.)
Bob Crawford, E.E.T. Inc., was present at the hearing. Requested a continuance, structure not modified. Double check with Natural Heritage. Addressed already. Motion to continue to January 7, 2008 at 7:10 p.m. Mr. Urbanski. Second Mr. Bjorklund. Motion passed by unanimous vote.

Wetlands Hearing: Braga, 81 Collier Road (additions & deck)
Frank Snow recused himself – tenant. Mark Stewart lives at 28 Collier Road. Paul Mirabito was present at the hearing. Abutters notification was submitted. Proposing a 32’x26’ addition on the easterly side. Had hearing at North River Commission. Existing saltmarsh and 2 flood zones, elevation 12’ AE flood zone; elevated deck on 1 or 2 sonotubes. Proposed poured concrete foundation not in flood zone. A 36’x20’ existing garage will be converted to a kitchen; keeping the garage doors for architectural purposes. Haybales along perimeter of work. Existing concrete deck, kitchen will be poured on that slab also. Garage and breezeway is the addition. Part of the existing garage will remain for storage. Hooked up to sewer. Sonotubes being hand dug? 2 only. Don’t show driveway for new garage. What type of surface. Gravel drive, assuming new would be paved. Commission may specify the surface; may not allow asphalt; pervious pavers; within the 100’ buffer. No grading proposed? Street is 19’ to 20’ elevation, maybe trench and some infiltrators. First floor of house 18’4”. Modify the plans for no grading. Adjust front of plan. New air conditioning pad to be built, now under garage. Will show on next plan. Foundation wall for garage going down 4’. All outside the 50’ line. Existing gravel drive will stay. Motion to continue to January 7, 2007 at 7:15 p.m. Mr. Urbanski. Second Mr. Bjorklund. Motion passed by unanimous vote.

Wetlands Hearing: McNamara, 23 Dartmouth Street (septic/garage)
Debra McNamara and Dale Schoeneman for Brad Holmes were present at the hearing. Abutters notification was submitted. Site includes a single family home, decks, seawalls, and pervious driveway. Wetland resources: developed barrier beach, coastal beach, coastal storm flowage, AO flood zone, depth 2’, site is not located in an estimated habitat area, according to 2006 program. Septic system repair leaching field, and piping, will connect to existing septic tank. Current leaching field will be removed. Construction of detached 2-car garage on western side, 30’x24’ on elevated concrete piers. Elevation 13’, 2’ above ground surface. In order to access elevated garage, pervious driveway will extend to proposed access ramp. Shed will be relocated on lawn area. All disturbed areas will be replaced with lawn, native trees, and groundcover. Leaching field has to be moved for the garage. Not necessary to keep 2 driveways. Look into pervious blocks with grass in the middle for the driveway. Shed to be removed. Specify depth of footings. Finished floor of garage will be at 13.0’. Top of foundation has to be at that; top of piers to be 13’. Change ramp angle, make it longer. Top of piers at 13’; finished floor would be at 14’ – 1’2” above base flood. Motion to close the hearing Mr. Urbanski. Second Mr. Greenbaum. Motion passed by unanimous vote.

Wetlands Hearing: Blondell, 550 Hatherly Road (septic)
Atty. Jeff Delisi, Ohrenberger’s office, and Mr. Blondell were present at the hearing. Abutters notification was submitted. Area subject to coastal storm flowage; mounded system; minimal grading; approved by Board of Health. No DEP file number. Motion to continue hearing to January 7, 2008 at 7:20 p.m. and try to set orders that night Mr. Urbanski. Second Mr. Snow. Motion passed by unanimous vote.

Wetlands Hearing: Fairbanks Trust, Glades Road (wetland delineation)
John Cavanaro, Cavanaro Consulting, and John Warner, Land Vest, also representing property owners, were present at the hearing. Abutters notification was submitted. Will need to hire a consultant to review the wetland line. Resource areas: floodplain, coastal bank, isolated wetland and salt marsh. Flags are in place on salt marsh side. Typically see more topo on plan. Isolated wetland was defined by vegetation. Coastal banks defined by elevation. Want more contours. Transects on separate plan is required. Great Rock Island shows exactly what has to be done to delineate top of bank. Might be area subject to flooding. Topo has to be on there; no sense in sending to consultant until plan is better. Motion to continue to January 22, 2008 at 6:30 p.m. Mr. Urbanski. Second Mr. Bjorklund. Motion passed by unanimous vote.

Environmental Bond Bill: asking for support – Bond program up in front of the legislature for Commission to support.

Don Hourhihan: Bloomstein & Brown, Mark Patterson was questioning a piling at the end of the pier. Parking problem down there.

Order of Conditions: Bloomstein, opposite 242 Central Ave. (pier/steps/deck/gangway & floats)
#42. There shall be no parking allowed on the lot. A plan shall be submitted for approval by the Commission showing a guardrail designed of 4”x4” timbers at a cross member along the lot, a minimum of 2’ off the ground.
