Town of Scituate Conservation Commission Meeting Minutes November 30, 2009Meeting was called to order at 6:17 p.m. Members Present: Mr. Snow, Chairman, Mr. Greenbaum, Mr. Bjorklund, Ms. Scott-Pipes 6:56 p.m. Also Present: Vincent J. Kalishes, Agent, Carol Logue, Secretary. Stormwater Regulations: 3 members until 6:56 p.m. Mandated by town meeting. Once passed at town meeting needs to be put into effect. These regulations dictate what will be done by the Planning Board, not projects under Commission jurisdiction. We will need to integrate the essence of these regs into our regs and give our own guidelines. There are stormwater management forms in the Notice of Intent. Issue a separate permit on larger projects or include as one permit? Paul Shea, Cohasset Conservation Agent: reviewed situation in Cohasset, where projects of 500 sq. ft. or more have to give all the calcs; sees Scituate’s thresholds as more reasonable. Projects under 15,000 sq ft will be reviewed by either Laura Harbottle or Vinny Kalishes; problem with thresholds has to do with impacts - a 15,000 sq. ft. project might not have a major impact, while a more sensitive 1,000 sq. ft. project might. Town meeting had no specific rules to follow. Anything that comes in front of the Commission will have to identify the stormwater issues, requiring an engineer to fill out the stormwater section. Change headings on all forms to include stormwater. Steve Bjorklund and Vin Kalishes reviewed the document, and want to sit down with Neil Duggan. Want to avoid requiring people to spend thousands of dollars. Mr. Bjorklund: regs as written seem overly redundant, with many questionable components. Should send letter to the Planning Board to request more time to review and discuss. Many projects would be affected. Who will chase them around? Paul Shea: Stormwater Agent needs to sign the document in Cohasset - Norfolk RAM receives $3,000 for the review engineer to look over the plans. Try to keep requirements in proportion with the project, using common sense. Commission consensus - send a letter to Planning stating we have spent some time with stormwater regs and will continue to do so. Agenda: Motion to amend the agenda to include a discussion of Goals & Objectives. Can be part of the Agent’s report Mr. Bjorklund. Second Ms. Scott-Pipes. Motion passed by unanimous vote. Show Cause Hearing: Hillman, 64 Edward Foster Road/3 Bridge Ave. (cont.) Ed Cavatorta, Quality Homes, and Mrs. Hillman were present at the hearing. Site is in good shape. Took a look at the plans for roof runoff. Mr. Kalishes’s opinion, doesn’t think they need them. Would like asphalt drive; leave crushed stone, give a year or so. Water & sewer lines were put in last week. Going to increase the runoff, catch basin on other side of Edward Foster Road. Won’t be flooding anyone else. Once grassed should pond before going into street with reasonably clean runoff. Put down splash pad. Infiltration won’t do much good given clay and high water table. Grass area and keep flat at the bottom so it doesn’t run right into the street. Pervious driveway: could do pavers set in sand, follow plan, except no infiltrators. Send a letter to that effect. All will be backfilled this week. Request for Determination: Maffei, 13 Holmes St (brick driveway & walkway/sod back lawn) Michael Lesher, J. Michael Landscaping, was present at the hearing. Driveway 6” gravel base with filter fabric. The area is 420 sq. ft. of paved area. Planting bed along fence – rosa rugosa and grasses. Should be an improvement over what is there. Grassed already. Motion for a negative 2 determination - “The work described in the Request is within an area subject to protection under the Act, but will not remove, fill, dredge, or alter that area. Therefore, said work does not require the filing of a Notice of Intent.” Ms. Scott-Pipes. Second Mr. Greenbaum. Motion passed by unanimous vote. Wetlands Hearing: Haufler, Lot 2 Peggotty Beach Rd (new build) (cont.) No quorum (Mr. Bjorklund not to be involved). Motion to continue to December 15, 2009 at 6:30 p.m. Ms. Scott-Pipes. Second Mr. Greenbaum. Motion passed by unanimous vote. Mr. Bjorklund abstained. Wetlands Hearing: Sandonato, 7 Wood Island Rd (raze/rebuild/septic) (cont.) Paul Shea was present at the hearing. Received Board of Health approval. Has to go to DEP. Submitted house plan and planting plan. Motion to close the hearing Mr. Bjorklund. Second Ms. Scott-Pipes. Motion passed by unanimous vote. Wetlands Hearing: Crary, 8 Oceanside Drive (elevate) (cont.) Received DEP File #68-2214. Motion to close the hearing Ms. Scott-Pipes. Second Mr. Bjorklund. Motion passed by unanimous vote. Wetlands Hearing: Egan, 7 Hawthorne St (septic) Received Board of Health approval. Motion to close the hearing Mr. Bjorklund. Second Ms. Scott-Pipes. Motion passed by unanimous vote. Wetlands Hearing: Dealy, 14 Hawthorne St (septic) Applicant’s representative requested continuance. Motion to continue the hearing to December 15, 2009 at 6:30 p.m. Ms. Scott-Pipes. Second Mr. Greenbaum. Motion passed by unanimous vote. Wetlands Hearing: Hyde, 66 Chief Justice Cushing Hwy. (addition) Paul Mirabito, Ross Engineering, Brad Holmes, Stas Zakrzewski, Architect, and Mr. & Mrs. Hyde were present at the hearing. All information was transferred to a surveyed plan. Brad Holmes: Native plantings are next to the BVW for a buffer zone enhancement. Revisions to proposed mitigation, extended phragmites removal to the north; submitted details on phragmites eradication. Will treat it for 5 years and after the 5th year will come back to see if they need to continue. At the preconstruction will go through which method will be used to remove the phragmites. Spoke with Chris Polatin, an expert on phragmites removal. One method is to drop a solution of Rodeo into each stem. Motion to close the hearing Ms. Scott-Pipes. Second Mr. Bjorklund. Motion passed by unanimous vote. Wetlands Hearing: Kent Street Corp./Duval, 25 Mill Wharf Plaza (aka 150R Front St) (reconfigure & reconstruct floats) Received DEP File #68- 2212. Motion to close the hearing Ms. Scott-Pipes. Second Mr. Bjorklund. Motion passed by unanimous vote.
Wetlands Hearing: Glades Club c/o Chamberlain Management Co., (1000) Glades Road (driveway relocation) Carlos Pena, CLE Engineering, and Arthur (Hap) Pompeo were present at the hearing. Abutters notification was submitted. In 2003 a Notice of Intent was filed to maintain the coastal bank adjacent to existing driveway. Driveway goes up the hill to the red cottage at the end of the point. Portions of the coastal bank have eroded, no sense battling the erosion. Located a place to put a driveway. Relocate 60’ to northwest and replicate old with salt tolerant plants at the top of the bank. No DEP File #. Regrade over the ledge, but there is a bit of an elevation problem. Delineate work area in the field before construction begins. Break up pavement in place and cover. Everything out there is gravel. Certain amount of fill required when putting in the new road. Replication for the new road: Break up asphalt and leave in place; vegetate area along the old road. Why disturb more by digging up and removing the asphalt? May create more erosion by removing. Will vegetate as needed. Problem of 20’ or 30’ section: will have to go around a ledge outcropping. Try to shape drive for less impact. Move further up to reduce disturbance. Needs a planting area behind where the garage was; currently a mess of rubbish. Order of Conditions: Crary, 8 Oceanside Drive (elevate) Will submit plan after elevating; need to see what is there, possibly modify for fewer pilings. Motion passed by unanimous vote. Request for Extension: Stewart, 27 Collier Rd. Motion to extend the Order of Conditions for 3 years Ms. Scott-Pipes. Second Mr. Bjorklund. Motion passed by unanimous vote. Agents Report: The Glenn has filed for the replication area and submitted a check for $7500 to hire consultant for peer review. Mr. Kalishes: can think of two – John Richardson or Steve Ivas. Commission thinks Mr. Ivas would be fine. Consensus: Request a proposal from each of them. Goals and Objectives: from the Open Space Plan. – conserve water resources, etc. Commit to work on two projects over the next year--TA wants time lines. One suggestion: the Spit and the birds. Have informational meetings to gather ideas from town officials and citizens. List items to be addressed by current plans and practices; develop a management plan defining use by humans and habitat areas, followed by a statement or policy for moving ahead. Have a final meeting before the season starts to present the management plan to the public. Continue with Driftway Park: determine next step in time for next year’s CPC proposals. Have to update and edit wetland regulations and add stormwater regs. Teak Sherman Park: Going to try to make a community garden. If Wheelwright property is acquired, will probably have more trail work. Need a master plan for the Carl Pipes Trail. Work out with Rod & Gun Club for parking for 2 or 3 cars. Ms. Scott-Pipes: Hope that the Commission will send a letter to CPC supporting the purchase of the Wheelwright & Bjorklund properties. Hope for access from the Rod & Gun Club. Good idea for Commission to encourage CPC to purchase properties. Mark Patterson asked for a letter for the harbor walk. Mr. Snow: no resistance from Rod & Gun Club when the bridge was built. Chain blocking off access to new road and new trail. Lot of different ways to use land in Scituate. Need a plan next year for the whole west end area. Brian Stewart was adamant that he did not want trails wide enough for motorized vehicles, just for walking. Motion to support purchase of Wheelwright and to support Harbor Walk Mr. Bjorklund. Second Ms. Scott-Pipes. Motion passed by unanimous vote. Consensus: Support all of them – Bjorklund, Wheelwright & Harbor walk. No quorum to vote on Mr. Bjorklund’s property. Mediation re: Saunders, Lot 7 Summer St: October 27 was the mediation meeting. Revised plan submitted November 3. Reduced wetland alteration from 425 sq. ft. to 208 sq. ft. Trying to build house on a marginal piece of property. 5,000 sq. ft. in the 50’ buffer zone. Should discuss with a full Commission. Superior Court: re: 25 Hawthorne, 86 & 87 Humarock Beach forwarded to Town Counsel. Glancy, 250 First Parish Rd is not going to do the back yard. Just removing the trees near the house and the addition.
